Farmington Hills — Ch. 7 Art. VIII Single-Family Rental Dwellings § 7-354
Violation and penalty
Operative Text
(a) A violation of any provision of this article shall constitute a municipal civil infraction, and shall be subject to the relief provided for municipal civil infractions under chapter 1 of this Code. (b) In addition, any use or activity in violation of the terms of this article is hereby declared to be a nuisance per se and may be abated by order of any court of competent jurisdiction. The city, in addition to other remedies, may cause to be instituted any appropriate action or proceeding to vacate the premises and/or prevent, abate or restrain the violation.
Section 7-354 of Farmington Hills Ch. 7 Art. VIII establishes that any breach of the Single-Family Rental Dwellings article is treated as a municipal civil infraction, carrying whatever relief is authorized under Chapter 1 of the city's Code. Beyond that civil infraction pathway, the same violation is automatically classified as a nuisance per se, meaning a court of competent jurisdiction can order it abated without requiring additional proof that harm occurred. The city retains the authority to pursue legal action to vacate the premises or otherwise stop and remedy the offending use or activity.

Operators of single-family rental dwellings in Farmington Hills should be aware that any departure from the requirements of Ch. 7 Art. VIII exposes them to a municipal civil infraction proceeding under Chapter 1 of the Code, as well as potential court-ordered abatement under § 7-354. Compliant operators generally maintain their properties in continuous conformance with all article requirements so that neither the civil infraction nor the nuisance-per-se designation is triggered. Because the city may seek to vacate the premises as a remedy, maintaining ongoing compliance is a central part of responsible rental property management in this jurisdiction.

Under § 7-354 of Farmington Hills Ch. 7 Art. VIII, tenants living in single-family rental dwellings benefit from a framework that treats landlord violations as both municipal civil infractions and nuisances per se, giving courts broad authority to order corrective action. Tenants who believe a violation is occurring may consider contacting the City of Farmington Hills directly to report the condition, since the city itself has standing to initiate legal proceedings to abate violations. Consulting a tenant-rights organization or legal aid provider familiar with Farmington Hills municipal code can help tenants understand which reporting or enforcement paths may be available to them.
