Plain English

Under Farmington Hills Ch. 7 Art. VIII § 7-344, no one may occupy a single-family rental dwelling, and no owner may rent or permit occupancy of one, unless a certificate of compliance has been applied for and issued. A limited exception exists for rental dwellings that were already in operation when the ordinance took effect: those properties may continue to be rented and occupied temporarily, but only if the owner meets a specific set of ongoing requirements, including timely registration, payment of applicable fees, scheduling of required inspections, and diligent pursuit of the certificate. The exception is conditional, not permanent — failure to satisfy any of those requirements removes the protection it provides.

For Property Managers

Operators of single-family rental properties in Farmington Hills should be aware that § 7-344 makes a valid certificate of compliance a prerequisite for lawfully renting or allowing occupancy of a dwelling. Compliant operators generally ensure they have applied for and received the certificate before a tenancy begins, and those who qualified for the transitional exception under the ordinance's effective date typically stay current on registration under § 7-343, pay fees required by § 7-352, and cooperate fully with inspection scheduling under § 7-349. Maintaining documentation of each step — application, fee payment, inspection coordination, and certificate issuance — is a practice commonly associated with demonstrating compliance under this article.

For Tenants

Section 7-344 of the Farmington Hills Code establishes that a single-family rental dwelling is not lawfully available for occupancy unless a certificate of compliance has been applied for and issued, which means tenants have an interest in knowing whether their unit is properly certified. If a tenant has reason to believe a certificate was never obtained or that the transitional exception's conditions were not met, that concern can generally be raised with the local code enforcement or municipal authority responsible for administering Ch. 7 Art. VIII. Tenant-rights organizations and legal aid resources can help individuals understand how the certificate requirement may be relevant to their particular rental situation.
