Detroit's Ch. 22 Art. III § 22-3-10 establishes a transparency and accountability framework for developers who receive ARPA and/or CARES Act funds from the City. Before City Council can approve such funding, the Housing and Revitalization Department must submit a detailed report covering the number and pricing of affordable units, the developer's commitment to keeping them affordable, leasing strategies targeting low-income and displaced residents, and ADA compliance plans. Once a contract is in place, the developer must file quarterly compliance reports, and the City retains the right to pursue clawback of funds if the developer fails to meet its stated commitments.

For Property Managers

Special developers subject to § 22-3-10 who seek ARPA or CARES Act funding from Detroit are generally expected to prepare thorough pre-approval documentation—including a formal commitment letter, a leasing strategy that addresses low-, very low-, and extremely low-income households as well as residents with past evictions and those living near the development, and ADA accessibility details. Compliant operators typically submit quarterly status reports to the Housing and Revitalization Department throughout the contract period. Failure to meet the representations made under § 22-3-10 can constitute a breach of contract and expose the developer to clawback of City, ARPA, and/or CARES Act funding.

For Tenants

Under § 22-3-10, Detroit residents—particularly those with low incomes, past evictions, or who live near a funded development—have a recognized interest in how special developers plan to lease affordable units created with public funds. City Council receives pre-approval reports and may request ongoing compliance information from the Housing and Revitalization Department, providing a public accountability mechanism. Residents who believe a funded developer is not honoring its commitments may consider contacting the Housing and Revitalization Department, raising concerns with their City Council representative, or reaching out to a local tenant-rights organization for guidance on available options.
