Wilmette — Ch. 8 Art. II Affordable Housing Consultation Procedures § 8-42
(a) Notwithstanding any other provision of this chapter or of the model codes adopted by reference in article IV of this chapter, prior to submitting to the Department of Community Development any application for any permit required by this chapter for a construction project identified in section 8-41 , the applicant shall meet with the Director of Community Development or the Director's designee. At such meeting, the Director of Community Development shall provide the prospective permit applicant with a copy of the village Affordable Housing Plan and will discuss with the prospective applicant whether there are reasonable options for including affordable housing units in the project. Additionally, at such meeting the Director of Community Development shall provide the prospective applicant a copy of the Planned Use Development provisions of the village Zoning Ordinance and related provisions of this Code.
(b) The meeting required in subsection (a) of this section shall be held at least 60 calendar-days prior to the date when an applicant for a construction project covered by section 8-41 files an application with the village, provided that after the required meeting, the Village Board by resolution may waive any remaining portion of the 60-day waiting period in cases where it determines that requiring an exhaustion of the waiting period would not serve the purposes of the plan.

Plain English

Section 8-42 of Wilmette's Code establishes a mandatory pre-application consultation process for certain construction projects. Before submitting a permit application for projects covered by Section 8-41, the applicant must first meet with the Director of Community Development (or a designee), who is required to share the village's Affordable Housing Plan and discuss whether the project could reasonably include affordable housing units. The meeting must occur at least 60 calendar days before the permit application is filed, though the Village Board may pass a resolution to waive any remaining portion of that waiting period if it determines the wait would not serve the plan's purposes.

For Property Managers

Developers and property owners planning construction projects subject to Section 8-41 generally schedule the required consultation with the Director of Community Development well in advance of any intended permit filing date, since Section 8-42 mandates at least a 60-day gap between that meeting and the application submission. At the meeting, compliant operators receive and review the village Affordable Housing Plan and the Planned Use Development provisions, and engage in a good-faith discussion about affordable housing options. If the timeline needs to be shortened, operators typically seek a Village Board resolution to waive the remaining waiting period rather than proceeding without completing the required steps.

For Tenants

Section 8-42 is designed to ensure that affordable housing considerations are formally raised before major construction projects in Wilmette move forward through the permitting process. Community members and tenant advocates can monitor whether developers of projects covered by Section 8-41 have completed the required pre-application consultation, since this step is a procedural prerequisite to permit approval. Those with concerns about compliance or the village's Affordable Housing Plan may contact the Department of Community Development directly or consult a tenant-rights organization familiar with local housing policy.
