Wheeling Ch. 4.84 § 4.84.080 defines several categories of violations related to rental residential property. Owners can be found in violation for failing to license their property, failing to vacate tenants after a license is revoked, or failing to maintain the structure in compliance with applicable building, property maintenance, and zoning ordinances. Occupants can be found in violation for failing to vacate within sixty days of receiving notice that the property is not properly licensed. Additionally, anyone who removes or defaces posted notices without authorization from the code official faces liability under this chapter.

Under Wheeling Ch. 4.84 § 4.84.080, compliant rental property owners generally ensure their property is licensed with the Village of Wheeling before renting it out and keep that license current. When a license is revoked, operators typically take prompt steps to vacate all tenants within the sixty-day window specified by the provision. Owners also maintain their structures and premises in ongoing compliance with applicable building, property maintenance, and zoning ordinances, and they take care not to remove or deface any notices posted by the code official.

Wheeling Ch. 4.84 § 4.84.080 establishes that occupants of an unlicensed rental property may be required to vacate within sixty days of receiving official notice from the code official. Tenants who receive such a notice may want to verify the licensing status of their unit and understand what rights and relocation resources may be available to them under local or state law. Tenant-rights organizations familiar with Wheeling's rental regulations can help explain what options generally exist when a property's license is at issue.
