Westchester — Ch. 7.128 Rental Residential Property Inspection and Licensing § 7.128.090
Tenant responsibilities
Operative Text
The following provisions shall be implied by law to be a term of every Residential Rental Agreement to which a Certificate of Inspection has been issued in effect within the Village as of and after the effective date hereof: (a) Every tenant, occupant or resident shall comply with all obligations imposed specifically upon tenants by provisions of the Municipal Code of Ordinances of the Village of Westchester applicable to residential dwelling units; (b) Every tenant, occupant or resident shall dispose of all ashes, rubbish, garbage and other waste from his dwelling unit in a clean and safe manner; (c) Every tenant, occupant or resident shall not deliberately or negligently destroy, deface, damage, impair or remove any part of the premises or knowingly permit any person on the premises with his/her consent to do so; and (d) Every tenant, occupant or resident shall conduct himself/herself and require other persons on the premises with his/her consent to conduct themselves in a manner that will not disturb the neighbors' peaceful enjoyment of their premises.
Westchester Ch. 7.128 § 7.128.090 establishes a set of tenant obligations that are automatically incorporated as implied terms into every residential rental agreement covered by a Certificate of Inspection within the Village. These obligations require tenants and other occupants to follow applicable municipal codes, dispose of waste safely and cleanly, refrain from deliberately or negligently damaging the property, and avoid disturbing neighbors' peaceful enjoyment of their homes. The rule applies to all occupants and guests permitted on the premises by the tenant, not just the lease-signatory alone.
Plain English — not legal advice.
Under § 7.128.090, landlords operating rental units subject to a Certificate of Inspection can rely on these tenant obligations being implied by law into every covered rental agreement, even if the lease document does not spell them out explicitly. Compliant operators typically document the condition of the unit at move-in and move-out, maintain records of any reported disturbances or property damage, and communicate the Village's Municipal Code requirements to tenants at the start of tenancy. Keeping clear records of waste disposal arrangements and neighbor-complaint histories can support enforcement of these implied lease terms if violations arise.

Section 7.128.090 outlines responsibilities that apply to tenants, occupants, and residents in Village of Westchester rental units covered by a Certificate of Inspection, regardless of whether these duties are written into the lease. These include proper waste disposal, avoiding damage to the property, and ensuring that guests do not disturb neighbors or damage the premises. Tenants who believe these obligations are being applied unfairly or who have questions about how they interact with other tenant rights may consult a local tenant-rights organization or review the Village's Municipal Code of Ordinances for additional context.
