Westchester — Ch. 7.128 Rental Residential Property Inspection and Licensing § 7.128.020
Inspection rights and penalties
Operative Text
This chapter shall not be construed to impede in any way the right of the village to inspect any property pursuant to any other provisions of this Code, nor to seek penalties for violations of other provisions of this Code.
Westchester Ch. 7.128.020 makes clear that the rental property inspection and licensing chapter does not limit or replace any other inspection authority or penalty provisions already established elsewhere in the village code. Other code sections retain their full, independent force alongside this chapter. In other words, the existence of this licensing framework does not create a shield against enforcement actions rooted in separate code provisions.
Plain English — not legal advice.
Under § 7.128.020, property owners and managers should understand that compliance with the rental inspection and licensing chapter does not insulate a property from inspections or penalties arising under other parts of the village code. Operators who maintain compliance across all applicable code sections — not just the rental licensing chapter — are best positioned to avoid enforcement actions. Keeping records of all inspections and any corrective actions taken under any code provision is a practice consistent with this multi-layered regulatory framework.

Section 7.128.020 preserves the village's full range of inspection and enforcement tools beyond the rental licensing chapter, which can be relevant to tenants experiencing conditions that may violate other provisions of the village code. Tenants may have grounds to raise violations of multiple code sections — not just the rental licensing rules — when seeking remedies for substandard conditions. Tenant-rights organizations familiar with Westchester village codes can help identify which provisions may apply to a given set of housing conditions.
