Plain English

Summit Village Code § 7-17-3 governs how the Village's department conducts rental property inspections under the Rental Occupancy License Program. Before any scheduled inspection, the Village must provide written notice to both the owner and occupants stating the date, time, and their right to withhold consent — which would require the Village to seek a warrant from the Circuit Court of Cook County. If a warrant is pursued, the court may weigh a range of factors, including tenant complaints, property deterioration, and prior violations. The section also establishes a fee schedule for reinspections: no fee for the initial inspection, $100 for the first reinspection, $200 for the second, and $300 for the third and any subsequent reinspections.

For Property Managers

Under § 7-17-3 of Summit's Rental Occupancy License Program, compliant property owners generally expect and prepare for written advance notice before any scheduled inspection. Operators who address code issues promptly after an initial inspection avoid the escalating reinspection fees — $100, $200, and $300 for successive reinspections — that apply when violations require follow-up visits. Keeping records of repairs and maintaining properties in accordance with Village Building, Zoning, Housing, Fire, and Property Maintenance codes helps demonstrate ongoing compliance if the department reviews the property's history.

For Tenants

Section § 7-17-3 of Summit's Rental Occupancy License Program gives occupants the explicit right to receive written notice before any scheduled inspection, including the date, time, and a statement of their right to withhold consent to the inspection. If consent is withheld, the Village must seek a warrant from the Circuit Court of Cook County, and tenant complaints are among the factors a court may consider when deciding whether to issue one. Tenants who believe their rights under this provision have not been respected may wish to contact a local tenant-rights organization or consult with an attorney familiar with Illinois housing law for general information about available options.
