Summit — Ch. 7-17 Rental Occupancy License Program § 7-17-2
Applicability
Operative Text
This Chapter shall be applicable to all residential properties in the Village that are rented or leased, which shall be defined as any residential dwelling unit, rooming unit or such other residential building or structure wherein the owner or owner's agent allows an individual or individuals to occupy space while charging a daily, weekly, monthly, quarterly or annual fee for the privilege of occupying said space. All areas of the residential dwelling unit to which the lessee or renter has the right of use or access shall be subject to inspection for compliance with the applicable codes and ordinances of the Village. This section shall not apply to any occupancy in existence at the time of the adoption of this Chapter until the change of occupancy occurs. Further, this section shall not apply to any land contract, contract for sale or any other property transaction wherein the new occupant has legally committed to acquire legal title to the property and has occupied the premises within sixty (60) days of the date of the contract. (Ord. 20-O-03, 1-6-2020)
Summit Village Code § 7-17-2 establishes which residential properties fall under the Rental Occupancy License Program. The rule covers virtually all rented or leased residential spaces in the Village — including dwelling units, rooming units, and similar structures — where any fee is charged for occupancy on a daily, weekly, monthly, quarterly, or annual basis. Two categories are carved out: occupancies that were already in place when the chapter was adopted (until a change of occupancy occurs), and situations where a new occupant has legally committed to purchase the property and moved in within 60 days of signing the contract.
Plain English — not legal advice.
Under § 7-17-2, property owners and managers operating rental units in Summit Village should understand that nearly every fee-based residential arrangement triggers the Rental Occupancy License Program's requirements. Compliant operators typically confirm whether their specific arrangement qualifies for one of the two exemptions — the grandfathered occupancy exception or the land-contract/purchase exception — before assuming the chapter does not apply. Because all areas of the unit to which a tenant has a right of use or access are subject to inspection, operators generally maintain those spaces in compliance with applicable Village codes and ordinances.

Section § 7-17-2 means that most renters in Summit Village — regardless of whether they pay daily, weekly, monthly, or on another schedule — are covered by the Rental Occupancy License Program, which includes the right to have all accessible areas of their unit inspected for code compliance. Tenants who believe their unit is not properly licensed or does not meet Village code standards may consider contacting the Village of Summit directly to inquire about the inspection and licensing process. Tenant-rights organizations can also help renters understand how the program's applicability rules interact with their specific living arrangement.
