The rights, obligations and remedies set forth in this chapter shall be cumulative and in addition to any other available at law or in equity. Plain English

Section 19-4 of Stickney's Chapter 19 on Condominium Conversions establishes that the rights and remedies created by the chapter stack on top of — rather than replace — any other legal or equitable remedies that might otherwise exist. The Village itself, as well as prospective buyers, actual purchasers, and unit owners, are each empowered to bring an action to enforce most provisions of the chapter, with one exception: only the Village may enforce Section 19-18. When a private party (not the Village) wins an enforcement action under any part of the chapter other than Section 19-18, that prevailing plaintiff is entitled to recover reasonable attorney's fees on top of any other relief granted.

For Property Managers

Operators involved in condominium conversions in Stickney should be aware that Section 19-4 gives multiple parties — including prospective and actual buyers — independent standing to pursue compliance with Chapter 19's requirements. Because a prevailing plaintiff in most enforcement actions can recover attorney's fees, non-compliance carries financial exposure beyond any underlying remedy. Maintaining thorough documentation of compliance with each provision of Chapter 19 is a practice commonly associated with operators who successfully navigate these requirements.

For Tenants

If you are a prospective purchaser, purchaser, or unit owner affected by a condominium conversion in Stickney, Section 19-4 confirms that you have standing to seek enforcement of most provisions of Chapter 19 in your own right — you do not need to wait for the Village to act. If you prevail in such an action (other than one under Section 19-18, which only the Village can bring), you may be entitled to recover reasonable attorney's fees, which can make enforcement more accessible. Tenant-rights organizations and legal aid offices familiar with Illinois condominium conversion law can help you understand what enforcement paths may be available under this chapter.
