Plain English

Sterling's Ch. 18 Art. XI § 18-304 divides housing maintenance responsibilities between property owners and permanent residents. Owners are required to keep rental premises habitable, handle pest extermination (unless caused by the occupant), maintain common areas and building exteriors, provide adequate garbage containers, and promptly address substandard conditions. Permanent residents, in turn, are responsible for keeping their units clean and sanitary, disposing of garbage properly, avoiding deliberate damage, and refraining from creating nuisances or disturbing neighbors. Both owners and residents can be issued citations for failing to meet their respective obligations under this provision.

For Property Managers

Under Sterling Ch. 18 Art. XI § 18-304, compliant property owners generally ensure that all rental units are clean, sanitary, and habitable before any new occupancy begins. Operators typically establish routine inspection and repair schedules to address deterioration, pest infestations, and substandard conditions promptly, and they maintain common areas in safe and sanitary condition. Owners also ensure adequate garbage containers are provided and that refuse is regularly removed from the premises, as failure to meet any of these duties can result in citations under this Code.

For Tenants

Sterling Ch. 18 Art. XI § 18-304 establishes that tenants have both rights and responsibilities: owners are obligated to provide and maintain habitable, pest-free, and structurally sound rental units, while tenants are expected to keep their units clean, dispose of garbage properly, avoid deliberate damage, and refrain from creating nuisances. If an owner fails to meet their maintenance obligations under this provision, tenants may have grounds to report violations to the appropriate local code enforcement authority, which has the power to issue citations. Tenants facing habitability concerns may also wish to consult a local tenant-rights organization to understand the range of options available under Sterling's housing code.
