South Beloit — Ch. 18 Art. XIV Residential Rental Property Registry § 18-466
Rental agreements—Required terms
Operative Text
(a) All rental agreements should be in writing. Effective January 1, 2026, all rental agreements shall be in writing and comply with this section. (b) All landlords shall incorporate into the body of all leases or rental agreements, or renewals of leases or rental agreements, the first and last names of all individuals 18 years of age or older, and the number of person(s) under the age of 18, who will reside or operate businesses at the subject property during the term of the lease. (c) All such landlords shall also require their tenants, as a condition of their lease, to provide written notice containing the first and last names of any guests who will be temporarily residing at the subject property for more than a calendar week (seven consecutive days). (d) Landlords shall provide, upon either oral or written request, copies of the information required in subsections (a), (b), and (c) to the community development director. Any such oral request shall be followed by a written e-mail confirmation of the oral request from the community development director of the City of South Beloit. (e) To the extent permitted by law, tenant agrees that service of process of any legal proceeding, including, but not limited to, a special detainer or forcible detainer action, or service of any notice to tenant, shall be effective and sufficient for purposes of providing legal service and conferring personal jurisdiction upon any Illinois court as to any tenant, co-signor, occupant or guarantor, if served upon any occupant or other person of suitable age and discretion who is present at the premises and residing therein, notwithstanding the fact that a tenant, co-signor, occupant or guarantor may reside at a different location other than the property address described in the lease agreement. This agreement regarding service is in addition to, and not in lieu of, any manner of service authorized under Illinois law or rule. By signing this lease, the undersigned hereby waives any objection to service carried out under the terms of this agreement.
South Beloit Ch. 18 Art. XIV § 18-466 establishes mandatory written-lease requirements for residential rental properties, effective January 1, 2026. Leases must identify all adult occupants by full name, note the count of minors, and require tenants to notify landlords in writing when any guest stays more than seven consecutive days. Landlords must also share this occupancy information with the city's community development director upon request, and the provision includes a service-of-process agreement that allows legal notices to be delivered to any suitable occupant present at the rental property.
Plain English — not legal advice.
Under South Beloit Ch. 18 Art. XIV § 18-466, compliant operators ensure that every lease or renewal executed on or after January 1, 2026, is in writing and lists the full names of all adult occupants along with the number of minor residents. Operators also include a lease condition requiring tenants to submit written notice identifying any guest who stays more than seven consecutive days. When the community development director requests occupancy records—whether orally or in writing—landlords are expected to provide copies promptly, and oral requests will be confirmed by the director via email.

South Beloit Ch. 18 Art. XIV § 18-466 gives tenants the right to a written lease that clearly identifies all adult occupants and sets out the guest-notification requirement before they are bound by it. Tenants should be aware that by signing a lease containing the service-of-process clause described in subsection (e), they are agreeing that legal notices may be delivered to another occupant present at the property, even if the named tenant lives elsewhere. Tenants who have questions about how these occupancy or service-of-process terms affect them may wish to consult a tenant-rights organization or legal aid provider familiar with Illinois landlord-tenant law.
