Plain English

Section 121.02 of Oakbrook Terrace's Chapter 121 establishes that rental dwellings may not be occupied by tenants unless the city has issued and the owner holds either a valid Temporary Residential Rental Certificate or both a valid Residential Rental Certificate and a rental dwelling license. Additionally, when a tenancy ends mid-license-term, the unit cannot be re-occupied until a valid certificate is in place. Short-term rentals lasting fewer than 28 consecutive days are prohibited in zoning districts where they are not permitted, and no certificate or license will be issued for such uses in those districts.

For Property Managers

Under § 121.02, compliant rental property owners and managing agents in Oakbrook Terrace ensure that valid city-issued certificates and licenses are in place before any tenant occupies a unit, including after a mid-term vacancy. Operators generally track certificate and license expiration dates and initiate renewals well in advance to avoid gaps in coverage. Owners also verify the zoning classification of any property before listing it for short-term rental, since § 121.02(C) bars both the rental activity and the issuance of any certificate or license for short-term use in non-permitted zones.

For Tenants

Section 121.02 gives tenants in Oakbrook Terrace a basis to inquire whether their landlord holds a valid Residential Rental Certificate or Temporary Residential Rental Certificate, as occupancy without one is prohibited under this provision. Tenants who believe a unit is being rented without the required city-issued credentials may consider contacting the City of Oakbrook Terrace directly to ask about the property's licensing status. Tenant-rights organizations can help residents understand how a landlord's failure to comply with § 121.02 might be raised in relevant proceedings or complaints.
