The requirements of compliance with current codes may be waived under the following circumstances:

B. Prior Compliance: With respect to the other provisions of this Code, if the unit containing the building and the common elements pertaining thereto were in compliance with the codes in force when the unit was built, and if current compliance would require structural changes.

North Chicago Title 12 Ch. 2 § 12-2-6 establishes three specific circumstances under which a condominium conversion project may be excused from meeting current building codes. The waivers apply to off-street parking counts (when the original count was code-compliant and current compliance would reduce available spaces), to structural elements of units and common areas (when originally code-compliant and current compliance would require structural changes), and to the total number and location of units within a building (when those were code-compliant at the time of construction). Outside these defined circumstances, full compliance with current codes is expected.

For Property Managers

Operators pursuing a condominium conversion in North Chicago should be aware that § 12-2-6 provides a narrow set of waiver pathways that compliant developers typically document carefully. This generally means assembling historical records showing that parking counts, structural elements, and unit numbers and locations met the codes in force at the time of original construction. Operators commonly prepare this documentation in advance of the conversion process to demonstrate eligibility for any applicable waiver under this section.

For Tenants

Under North Chicago Title 12 Ch. 2 § 12-2-6, tenants in a building undergoing condominium conversion have an interest in understanding whether any waivers from current code requirements have been claimed by the building owner. If a waiver appears to have been applied improperly — for example, if parking spaces were reduced or structural changes were made without meeting the conditions set out in this section — tenants may have grounds to raise that issue with the appropriate local authority or a tenant-rights organization. Reviewing the conversion documentation and consulting a tenant-rights resource are general paths available to those who want to understand how this provision applies to their building.
