Plain English

Section 12-2-2 of North Chicago's Condominium Conversion ordinance establishes the vocabulary used throughout the chapter. Key terms such as 'persons,' 'unit owner,' 'unit,' 'common elements,' 'property,' 'declaration,' and 'plat' carry the same meanings as defined in the Illinois Condominium Property Act. Additionally, the ordinance broadens the meaning of 'sell' and related terms to cover advertising and soliciting, and defines 'codes' and 'current codes' to encompass all applicable city building, zoning, and related regulations in effect when an inspection certificate application is submitted.

For Property Managers

Property owners and managers involved in condominium conversions in North Chicago should be aware that under § 12-2-2, any advertising or soliciting of units for sale is treated the same as a completed sale for regulatory purposes. The definition of 'current codes' ties compliance to the building, plumbing, heating, electrical, cooling, elevator, and parking standards in force at the time an inspection certificate application is filed—not at any earlier point. Operators generally ensure that all marketing materials and inspection applications align with these definitions to avoid inadvertently triggering obligations under the broader chapter.

For Tenants

Under § 12-2-2, tenants in buildings undergoing condominium conversion should know that the ordinance's protections apply from the moment a unit is advertised or solicited for sale, not only after a formal sale is completed. The broad definition of 'codes' means that the physical condition of the building—including plumbing, heating, electrical systems, and parking—must meet city standards current at the time an inspection certificate is sought. Tenants who believe these standards are not being met may wish to contact a local tenant-rights organization or review the full North Chicago Condominium Conversion chapter for guidance on available remedies.
