Norridge — Ch. 22 Art. XII Rental Property Licensing Code § 22-606
In the event that an owner occupies a residential rental dwelling unit that the owner has previously licensed under this article with the owner's intent to continue to occupy that dwelling unit as an owner occupied dwelling unit, and not rent or lease the dwelling unit to a third party tenant for, or not for compensation, the owner shall notify the village within ten days of such occupation and surrender the village license issued for that dwelling unit and that dwelling unit shall be exempt from the provisions of this article. Thereafter, unless the owner shall determine to return the dwelling unit to rental status, the owner shall not be subject to the regulations set forth in this article for that dwelling unit. Any license or inspection fees previously paid to the village pursuant to this article are not refundable and licenses and license fees will not be prorated.

Under Norridge Ch. 22 Art. XII § 22-606, when an owner moves into a previously licensed rental unit with the genuine intent to live there permanently rather than rent it out, that unit can be removed from the rental licensing program. The owner must notify the Village within ten days of moving in and return the existing rental license. Once those steps are completed, the unit is exempt from the article's requirements for as long as it remains owner-occupied, though any fees already paid are non-refundable and will not be prorated.

For Property Managers

Under § 22-606, a property owner who converts a licensed rental unit into their own primary residence must act promptly: the Village must be notified and the rental license surrendered within ten days of taking occupancy. Compliant operators document their intent to occupy the unit personally and retain records of the notification and license surrender. Owners should also be aware that if the unit is later returned to rental status, it would again fall under the article's licensing requirements, and no refund or proration of previously paid fees is available.

For Tenants

Section 22-606 governs situations where a landlord reclaims a previously licensed rental unit for personal occupancy, which removes that unit from Norridge's rental licensing protections under Ch. 22 Art. XII. Tenants in units undergoing this transition may want to verify that the owner has properly notified the Village and surrendered the license as required by the provision. Tenant-rights organizations or a housing attorney can help clarify what rights may apply during or after such a transition, including whether the owner's stated intent to occupy is consistent with the requirements of § 22-606.
