Mundelein — Ch. 16.44 Rental Housing Properties § 16.44.070
It is hereby declared a nuisance and to be declared against the health, peace and comfort of the village for any residential rental property owner or property agent to knowingly allow or permit the following: The rental of a residential unit or residential building within an apartment community or governed by a homeowner's association to a tenant who allows a violation as defined in Chapter 9.76 (Ordinance No. 00-6-26), abatement of chronic nuisance properties as it relates to the tenant, member of the tenant's household, guest, or other party under control of the tenant.

Plain English

Mundelein § 16.44.070 establishes that a residential rental property becomes a declared nuisance when its owner or property agent knowingly allows or permits a unit to be rented to a tenant whose household, guests, or other parties under their control commit violations defined under the village's chronic nuisance ordinance, Chapter 9.76 (Ordinance No. 00-6-26). The rule links rental housing oversight to the village's broader chronic nuisance abatement framework, meaning that repeated or knowing tolerance of such violations can expose a property to nuisance designation. This applies to units within apartment communities and homeowner's association-governed buildings alike.

For Property Managers

Under Mundelein § 16.44.070, compliant property owners and agents generally take active steps to monitor whether tenants, household members, guests, or other parties under a tenant's control are engaging in conduct that qualifies as a chronic nuisance violation under Chapter 9.76 (Ordinance No. 00-6-26). Operators who become aware of such violations typically document the issue and take appropriate action through lease enforcement mechanisms rather than knowingly allowing the conduct to continue. Maintaining clear lease language that references the village's nuisance standards and keeping records of any corrective steps taken are practices commonly associated with compliance.

For Tenants

Mundelein § 16.44.070 is primarily directed at property owners and agents, but tenants should be aware that conduct by household members, guests, or others under their control that constitutes a chronic nuisance violation under Chapter 9.76 (Ordinance No. 00-6-26) can trigger nuisance designation for the property. Tenants who believe this provision is being applied to them unfairly, or who have questions about what qualifies as a violation under the referenced ordinance, may wish to review Chapter 9.76 directly or consult a tenant-rights organization familiar with Mundelein's local code. Understanding the scope of the chronic nuisance ordinance can help tenants recognize what behaviors may put their tenancy or housing at risk under this provision.
