Certificate
Operative Text
(a) (1) The certificate of registration shall expire each year on the 30th of April, or when one of the following occurs: (A) Title to the property covered by the certificate of registration is transferred or conveyed so that fifty percent or more of the record ownership or beneficial interest therein has changed. (B) The residential rental property covered by the certificate of registration is damaged or destroyed to the extent that any dwelling unit is uninhabitable. (C) The residential rental property is altered, remodeled, maintained, or repaired without a proper permit for work issued by the Village of Mundelein. (D) The certificate of registration is lawfully revoked or suspended. (b) Initial Application for Certificate of Registration. An initial application shall be submitted on a form provided by the village. The initial application shall include the information required herein as existing on the effective date of this amendment. An initial application is required only once for each residential rental property unless ownership changes as provided in subsection (a)(1)(A). (c) Renewal Certification. (1) After approval of an initial application, annual renewals shall not require submission of a new application form. (2) Each year on or before May 1, the owner or property agent shall submit the required renewal fee and a renewal certification, electronically or in another format designated by the village, confirming that the information provided in the initial application remains accurate or providing updated information for any changes. (3) Failure to provide updated information when changes have occurred shall constitute a violation of this chapter. (4) Renewal certifications submitted electronically shall have the same legal effect as certifications submitted in any other format designated by the village. (d) Fees. Each initial application and each annual renewal certification shall be accompanied by the applicable fee listed in the Village Fee Schedule. (e) The first application for a certificate of registration and fee shall be due within sixty days of the adoption and effective date of the ordinance from which this chapter is derived for all residential rental property presently occupied, and for all residential rental property presently held out for occupancy, or at least sixty days prior to the occupancy of any residential rental property at any time after the enactment of the ordinance from which this chapter is derived. (f) Each application form and certificate of registration issued thereon shall apply to a single address with the improvements thereon, and operated as one proprietary unit, listing each dwelling unit contained therein. Condominiums shall indicate the street address and unit number, and shall be considered as one proprietary unit. (g) Once issued, a certificate of registration cannot be transferred or assigned to another residential rental property or to a successor owner. (h) If a certificate of registration is revoked, suspended or is no longer valid, a certificate of registration shall be obtained using the same procedure, application, inspection and fee as is required for an original certificate of registration. (i) A certificate of registration issued for an address containing more than one dwelling unit may be revoked in part for any dwelling unit or portion of the residential rental property that is not in compliance with this chapter. The letter of revocation or suspension issued by the administrative hearing officer shall indicate which dwelling unit(s) or portions of the residential rental property are in violation, and the corrective action necessary. (j) Until written notification of a change of the address is received by the village, any notice to be provided under the provisions of this chapter or the codes specified herein shall be deemed sufficiently given if deposited in the United States mail 1st Class, postage prepaid and addressed to the person at the address listed on the application. If an owner is not a resident of the village, the owner may designate an agent for purposes of this subparagraph.
Mundelein Ch. 16.44 § 16.44.040 establishes how certificates of registration for residential rental properties are obtained, maintained, and lost. A certificate expires annually on April 30 and can also become invalid earlier if ownership changes significantly, a unit becomes uninhabitable, unpermitted work is performed, or the certificate is revoked or suspended. Once issued, a certificate is tied to a specific address and owner and cannot be transferred to a new property or successor owner.
Plain English — not legal advice.
Under § 16.44.040, compliant rental property operators in Mundelein keep their certificate of registration current by submitting a renewal certification and the applicable fee by May 1 each year, confirming that all information on file remains accurate or providing updates where anything has changed. Operators also ensure that any construction, remodeling, or repair work is covered by a proper Village of Mundelein permit, since unpermitted work is one of the triggers that can invalidate a certificate. When ownership of a property changes by fifty percent or more, a new initial application is required rather than a simple renewal.
General guidance for property managers — not legal advice for your specific situation. Consult an attorney for advice on your case.
Section 16.44.040 of Mundelein's Rental Housing Properties chapter requires landlords to hold a valid certificate of registration, and that certificate can be revoked or suspended when a property is not maintained in compliance with the chapter. Tenants who believe their landlord is operating without a valid certificate, or that a certificate should have been revoked due to habitability or code issues, may raise this as a concern with the Village of Mundelein or reference it in any administrative hearing process. Tenant-rights organizations familiar with Mundelein's local ordinances can help explain what options are generally available when a landlord's registration status is in question.
