Morton Grove — Ch. 10-11 Condominium Conversion § 10-11-1
CONVERSION REGULATIONS
Operative Text
A. Compliance Required: Any provision in any lease or other rental agreement, or any termination of occupancy on account of condominium conversion, not authorized herein, or contrary to or waiving the foregoing provisions, shall be deemed to be void as against public policy. B. Conflicting Regulations: In the event this chapter, or any section or paragraph thereof, are different than or conflict with the Condominium Property Act of Illinois 1 , then the provisions of this chapter shall prevail within the corporate limits of the Village. State Law reference-- 1 765 ILCS 605/1.
Morton Grove Ch. 10-11 Condominium Conversion § 10-11-1 establishes that any lease clause, rental agreement provision, or occupancy termination tied to a condominium conversion that is not expressly permitted by this chapter—or that attempts to waive its protections—is automatically void as a matter of public policy. The chapter also asserts local supremacy: where its rules differ from or conflict with the Illinois Condominium Property Act (765 ILCS 605/1), Morton Grove's local rules govern within village limits. This means the village's conversion regulations set the floor for tenant and landlord conduct, and private agreements cannot contract around them.
Plain English — not legal advice.
Property owners and managers undertaking a condominium conversion in Morton Grove must structure all lease terms, rental agreements, and any occupancy terminations strictly within the framework authorized by Ch. 10-11 Condominium Conversion § 10-11-1. Compliant operators generally review their conversion-related documents to ensure no clause attempts to waive or circumvent the chapter's protections, since such clauses are rendered void by operation of law. Where the village's requirements differ from the Illinois Condominium Property Act, operators follow the Morton Grove chapter, as it prevails within village boundaries.

Under Morton Grove Ch. 10-11 Condominium Conversion § 10-11-1, tenants are protected from lease or rental agreement provisions—and from occupancy terminations—that are not authorized by the chapter or that attempt to strip away its protections; such provisions are void as against public policy. If a landlord presents conversion-related terms that appear to waive these rights, tenants may raise the unenforceability of those terms as a defense in any related proceeding. Tenants who believe their rights under this chapter have been violated may consider contacting the Village of Morton Grove, consulting a tenant-rights organization, or seeking independent legal guidance to understand available options.
