Plain English

Melrose Park Ch. 15.76 § 15.76.050 establishes financial and legal consequences for violations of the village's condominium conversion rules. Fines range from $100 to $750 per offense, and each day a violation continues counts as a separate offense, meaning penalties can accumulate quickly over time. Beyond fines, the village may also pursue injunctive relief—such as halting the occupancy or sale of a unit or building—and these remedies stack on top of any other applicable village code penalties. Liability can fall on the developer, the individual unit owner, or the homeowners association, depending on where the violation occurs.

For Property Managers

Operators and developers subject to Melrose Park Ch. 15.76 § 15.76.050 generally maintain continuous compliance with all condominium conversion requirements, since each day of non-compliance can be treated as a distinct, separately fineable offense. Compliant parties keep documentation showing that both individual units and common areas meet chapter standards, because liability under this section can be assigned to the developer, unit owner, and association simultaneously. Operators also remain aware that the village holds authority to seek injunctive relief—including blocking sales or occupancy—in addition to any monetary fines imposed.

For Tenants

Melrose Park Ch. 15.76 § 15.76.050 provides tenants and prospective buyers with meaningful protections by holding developers, unit owners, and associations each accountable for violations in their respective areas. If a violation is occurring—whether in a unit or a common area—multiple responsible parties can be cited, and the village can pursue both fines and court orders to stop unlawful occupancy or sales. Individuals who believe a violation is affecting them may consider contacting the Melrose Park village offices to report the issue, or reaching out to a tenant-rights organization for general guidance on available options.
