McCook — Ch. 18 Art. XIV Rental Housing § 18-415
(a) The building commissioner may refuse to issue or renew a landlord license in whole or in part for past violations of this article, violations of the Property Maintenance Code, refusal to take steps to mitigate against or prevent future violations of this article or the Property Maintenance Code, failure to complete any requirements of a conditional license, threats to the health safety and welfare of the tenants/occupants/public, if the landlord has had the landlord license denied, suspended or revoked in the past by the village or other municipality operating under similar regulations and cannot show that the circumstances attending such action has been remedied or that steps have been taken to prevent future violations of a similar nature, and the falsification of information or documents required to be submitted under this article.
(b) The building commissioner shall make his determination in writing which shall include the factual basis and legal conclusion for his determination. The building commissioner's determination shall be mailed to the landlord by Certified U.S. Mail, return receipt requested or by personal service, no later than 30 days after the application for issuance or renewal is submitted or, within three business days of a landlord or rental manager's failure to timely complete any requirements of a conditional license.
(c) The refusal to issue or renew a landlord license may be partial (i.e., for a particular dwelling unit(s)) or in whole (i.e., for all dwelling units proposed to be governed by a particular license) depending on the circumstances. A determination not to issue or renew a landlord license in whole shall be supported by a finding that the prior violations were systematic, the result of willful actions or omissions, on-going despite warnings or requests for compliance by the building commissioner, or otherwise constitute a universal threat to the health, safety and welfare of the tenants governed by the license.
(d) In lieu of refusing to issue or renew a landlord license, the building commissioner may issue a determination that a conditional landlord license is appropriate under the circumstances. A conditional crime-free residential license shall be valid for a limited time-period during which the landlord shall be required to undertake and satisfy certain measures identified by the building commissioner before a landlord license is issued or renewed. The conditions imposed shall be directed towards remedying past violations, the prevention of future violations under this article, or as a probationary technique to ensure the landlord or rental manager understands and has taken measures to ensure compliance with this article. A landlord license shall not be issued if the landlord fails to complete or violates the conditions listed in the building commissioner's determination in the time-period referenced. A landlord may appeal the building commissioner's decision not to issue or renew a landlord license.
(e) The building commissioner's decision shall be final and take immediate effect 14 days after it is issued assuming no appeal is taken.

Plain English

McCook Ch. 18 Art. XIV § 18-415 establishes the grounds and process by which the building commissioner may refuse to issue or renew a landlord license. Refusal can be triggered by past code violations, falsified documents, unresolved prior license actions in any municipality, or threats to tenant health and safety. The denial can apply to individual units or an entire license, and the commissioner must provide a written determination with factual and legal reasoning, delivered within 30 days of application. A conditional license is an alternative option, and landlords have the right to appeal a denial before it becomes final 14 days after issuance.

For Property Managers

Under McCook Ch. 18 Art. XIV § 18-415, compliant operators generally maintain accurate records, address Property Maintenance Code violations promptly, and fulfill any conditions attached to a conditional license within the required timeframe. The building commissioner's written determination—delivered by certified mail or personal service—will specify the factual and legal basis for any refusal, so operators benefit from keeping documentation of remediation efforts. If a license is denied or conditioned, an appeal is available and must be pursued before the decision becomes final 14 days after issuance.

For Tenants

McCook Ch. 18 Art. XIV § 18-415 gives tenants an indirect but meaningful protection: a landlord's history of code violations, threats to health and safety, or falsified documents can result in the building commissioner refusing to issue or renew that landlord's license. Tenants who are aware of ongoing violations or unsafe conditions may consider reporting them to the building commissioner's office, as documented violations can factor into licensing decisions. Tenant-rights organizations can help residents understand how this provision interacts with their broader rights under McCook's rental housing regulations.
