Hillside — Ch. 18 Art. XV Systematic Inspection of Rental Housing § 18-646
Penalties
Operative Text
(a) Failure to pay an inspection fee will result in a certificate of compliance not being issued. (b) Any person violating any provisions of this section shall be subject to penalties as provided in section 1-10 of the Code. (c) Any person violating any provision of section 18-634 though and including section 18-645 shall be fined not less than $50.00 nor more than $75.00, and each day upon which a violation occurs or continues shall be deemed a separate offense.
Section 18-646 of Hillside's Code establishes the consequences for failing to comply with the Systematic Inspection of Rental Housing program. Unpaid inspection fees result in the withholding of a certificate of compliance. Violations of the underlying rental housing inspection provisions (§§ 18-634 through 18-645) carry fines ranging from $50 to $75, with each day a violation persists treated as a distinct, separately punishable offense.

Operators subject to Hillside's rental housing inspection program under Ch. 18 Art. XV should be aware that § 18-646 ties the issuance of a certificate of compliance directly to timely payment of inspection fees — no payment means no certificate. Fines for violations of §§ 18-634 through 18-645 accrue on a per-day basis, meaning a prolonged unresolved violation can multiply the total financial exposure quickly. Compliant operators generally ensure inspection fees are paid promptly and that any cited conditions are corrected without delay to avoid compounding penalties.

Section 18-646 of Hillside's Ch. 18 Art. XV gives tenants a useful reference point when evaluating whether a landlord is meeting the municipality's rental housing inspection obligations. If a property lacks a valid certificate of compliance — which can result from an unpaid inspection fee — that status may be relevant information when raising concerns with local code enforcement. Tenants who believe violations of §§ 18-634 through 18-645 are ongoing may wish to contact Hillside's code enforcement office or a local tenant-rights organization to understand available options.
