Hillside — Ch. 18 Art. XV Systematic Inspection of Rental Housing § 18-635
Inspection of rental dwellings
Operative Text
(a) Inspection. Any rental dwelling that is leased or rented shall be subject to inspection by a code official on an annual basis, upon a request of a tenant or owner or for cause, for the purpose of determining that the rental dwelling is in compliance with all applicable laws. (b) Notice of inspection. The code official shall give a minimum of 30 days advance written notice of the inspection to the Owner or at least one of the occupants of the rental dwelling. Notice shall be given to the Owner by either mailing notice to the address of the person or entity to whom real estate tax bills are mailed or by hand delivery to the owner. Notice shall be given to the occupant(s) by mailing the notice to the address of the rental dwelling to be inspected or by hand delivery of the notice to an occupant who is 18 years of age or older or by posting the notice on the front door of the rental dwelling. (c) Consent to inspection. If owners or non-owner occupants do not consent to the code official's entry for inspection pursuant to this article, the code official may not otherwise attempt to gain entry except with an administrative search warrant issued from a competent authority in accordance with the applicable law.
Under Hillside Ch. 18 Art. XV § 18-635, rental dwellings are subject to code inspections on an annual basis, as well as upon tenant or owner request or for cause, to verify compliance with applicable laws. Before any inspection, the code official must provide at least 30 days of written advance notice to the owner and/or an occupant, delivered by mail, hand delivery, or door posting. If an owner or occupant withholds consent to entry, the code official must obtain an administrative search warrant from a competent authority before proceeding.
Plain English — not legal advice.
Under § 18-635, property owners should expect to receive written notice at least 30 days before a scheduled annual inspection, sent to the address on file for real estate tax billing or delivered by hand. Compliant operators generally ensure their contact information is current with the relevant taxing authority so that notice reaches them reliably, and they maintain the rental dwelling in conformance with all applicable codes ahead of any inspection. Owners who choose not to consent to entry are protected by the warrant requirement, though routine cooperation with scheduled inspections is a common practice among operators seeking to demonstrate ongoing compliance.

Section 18-635 gives tenants the right to request an inspection of their rental dwelling at any time, in addition to the annual inspections that apply to all covered rentals in Hillside. Tenants should be aware that at least 30 days of written advance notice is required before a code official may enter, and that notice may be mailed to the rental address, hand-delivered, or posted on the front door. Tenants who have concerns about code compliance or who believe an inspection was conducted improperly may contact the Hillside code enforcement office or a local tenant-rights organization to understand available options under this article.
