Glenwood — Ch. 26 Art. XI Landlords § 26-819
Penalties
Operative Text
Any short-term rental owner or other person or entity who violates any of the provisions in this chapter shall be subject to the following penalties: (a) A fine of $1,000.00 for a first offense within a 12-month period, and a fine of $2,500.00 for a second or subsequent offense within a 12-month period. (b) Each day that a violation of this chapter continues shall be considered a separate and distinct offense, and a fine shall be assessed for each day a provision of this chapter is violated. Notwithstanding the foregoing, the fine for a second or subsequent offense as set forth in subsection (a) above shall not be imposed until there has been a prior adjudication of a violation against the same individual or entity. (c) The village may institute an action for injunctive relief or a mandamus action or may seek any other applicable relief to enforce this chapter.
Glenwood Ch. 26 Art. XI § 26-819 establishes a tiered fine structure for violations of the village's short-term rental regulations. A first offense within any 12-month period carries a $1,000 fine, while a second or subsequent offense within the same period carries a $2,500 fine — but that higher penalty cannot be imposed unless a prior violation by the same person or entity has already been formally adjudicated. Importantly, each day a violation continues counts as its own separate offense, meaning fines can accumulate daily. The village also retains the right to pursue injunctive relief or other legal remedies beyond monetary fines.
Plain English — not legal advice.
Short-term rental owners and operators in Glenwood should be aware that § 26-819 creates compounding financial exposure: a single unresolved violation can generate a new $1,000 fine for every day it remains uncorrected. Compliant operators generally act promptly to cure any identified deficiency before it persists across multiple days. Keeping thorough records of corrective actions taken in response to any notice of violation is a practice commonly associated with demonstrating good-faith compliance under provisions like this one.

While § 26-819 primarily targets short-term rental owners and operators, neighboring residents and tenants affected by non-compliant short-term rentals may have an interest in understanding that the Village of Glenwood has enforcement tools available, including daily fines and the ability to seek injunctive relief. Individuals who believe a short-term rental in their area is operating in violation of Ch. 26 Art. XI can generally report concerns to the appropriate village department or code enforcement office. Tenant-rights organizations and local legal aid resources can help explain how these enforcement mechanisms may be relevant to a particular living situation.
