Evanston, Ill., City Code § 5 § 5-3-6-5
FAIR NOTICE REGARDING RENEWAL (Evanston Housing Regulations)
Operative Text
(A) If the rental agreement will not be renewed or if a month-to-month tenancy will be terminated, the housing provider shall provide written notice of the nonrenewal to the tenant no less than ninety (90) days prior to the termination date. (B) If the housing provider fails to give the notice required by Subsection 5-3-6-5 (A) to the tenant, the lease term shall be extended and the tenant may remain in the dwelling unit for ninety (90) days, after the date that such written notice is received by the tenant. During such period, the terms and conditions of the tenancy shall be the same as the terms and conditions during the month of the tenancy immediately preceding the notice. (C) A housing provider who wishes to renew a rental agreement must provide the proposed new rental agreement to the tenant not less than ninety (90) days prior to the termination date of the current rental agreement. No tenant shall be required to renew a rental agreement more than forty-five (45) days prior to the termination date of the current rental agreement. (D) If the housing provider fails to give the notice required by Subsection 5-3-6-5 (C) within the time provided, the lease term shall be extended and the tenant may remain in the dwelling unit for ninety (90) days after the date that such written notice is received by the tenant. During such period, the terms and conditions of the tenancy shall be the same as the terms and conditions during the month of the tenancy immediately preceding the notice.
Under Evanston, Ill., City Code § 5-3-6-5, housing providers must give tenants at least 90 days' written notice before terminating or not renewing a tenancy, and must deliver any proposed renewal agreement at least 90 days before the current lease ends. Tenants, in turn, cannot be required to commit to a renewal more than 45 days before the lease expires. If a housing provider misses either deadline, the law automatically extends the tenancy by 90 days from the date the late notice is actually received, on the same terms as the prior month.
Plain English — not legal advice.
Operators subject to Evanston, Ill., City Code § 5-3-6-5 generally track lease expiration dates well in advance so that nonrenewal notices and proposed renewal agreements are delivered at least 90 days before the termination date. Compliant housing providers document the date written notice is delivered to the tenant, since the 90-day extension clock starts from the date of receipt if notice is late. Keeping a calendar reminder at least 100 days out helps ensure the required window is met and avoids an unintended lease extension on existing terms.

Evanston, Ill., City Code § 5-3-6-5 gives tenants the right to receive at least 90 days' written notice of nonrenewal or termination, and to receive any proposed new lease at least 90 days before the current one ends — while not being obligated to sign a renewal more than 45 days out. If a housing provider delivers either notice late, the provision automatically extends the tenancy for 90 days from the date the notice is received, preserving the prior month's terms. Tenants who believe their housing provider has not complied may consider contacting the City of Evanston's housing office, a local tenant-rights organization, or an attorney familiar with Evanston housing law to understand available options.
