Evanston, Ill., City Code tit. 5 (2026) § 5-3-11
CONDOMINIUM CONVERSIONS (Evanston Housing Regulations)
Operative Text
In the event that any of the provisions of this Chapter conflict with provisions of the Residential Condominium Conversion Ordinance (Section 5-4-4-5), the provisions of this Chapter shall control and prevail.
Section 5-3-11 of Evanston's City Code establishes a conflict-resolution rule between two related bodies of local housing law. When any provision of the Chapter containing this rule directly conflicts with a provision of the Residential Condominium Conversion Ordinance (Section 5-4-4-5), the Chapter's rules take precedence. This means the Condominium Conversion Ordinance's terms are effectively overridden to the extent of any such conflict.

Property owners and managers involved in condominium conversion projects in Evanston should be aware that under § 5-3-11, the broader Chapter's requirements will govern whenever they clash with the Residential Condominium Conversion Ordinance (Section 5-4-4-5). Compliant operators generally review both sets of rules side by side to identify any areas of overlap or contradiction before proceeding with a conversion. Understanding which set of rules controls can affect how conversion-related obligations, notices, and tenant protections are applied in practice.

Under Evanston City Code § 5-3-11, tenants living in buildings undergoing condominium conversion benefit from knowing that the Chapter's protections take priority over the Residential Condominium Conversion Ordinance (Section 5-4-4-5) in any area of conflict. This hierarchy of rules can affect the scope of rights and protections available during a conversion process. Tenants who believe their rights may be affected by a conversion can consult a local tenant-rights organization or the City of Evanston to understand which rules apply to their situation.
