Elgin — Ch. 16.44 Roominghouses § 16.44.040
License; application
Operative Text
A written application upon blank forms furnished by the city clerk shall be filed with the city clerk on or before January 1 of each year and shall accurately state: A. The full name and address of the applicant and the person in whose name such license is to be issued; B. The full name and address of the owner of the building and premises where such roominghouse use is proposed to be carried on; C. The number of rooms in such building and which of said rooms in said building are to be occupied as sleeping rooms; and D. The number of persons proposed to be accommodated or allowed in each room.
Section 16.44.040 of Elgin's Municipal Code establishes the annual licensing requirement for roominghouses. Each year, operators must submit a written application to the city clerk by January 1, using official forms provided by the clerk's office. The application must accurately disclose the identities of the applicant and building owner, the layout and intended use of rooms, and the proposed occupancy numbers for each sleeping room.

Under § 16.44.040, compliant roominghouse operators obtain the required application forms from the Elgin city clerk's office and submit a fully completed, accurate application before the January 1 annual deadline. The application must identify both the applicant and the building owner by full name and address, specify which rooms will serve as sleeping rooms, and state the number of occupants proposed for each room. Operators generally keep records of submitted applications and any correspondence with the city clerk to document timely and accurate filings.

Section 16.44.040 requires that the roominghouse where you live be licensed annually with the city of Elgin, with accurate information about the building's ownership, room designations, and occupancy limits on file with the city clerk. If a roominghouse appears to be operating without a current license or with inaccurate occupancy information, tenants may contact the Elgin city clerk's office or local code enforcement to inquire about the property's licensing status. Tenant-rights organizations familiar with Elgin's municipal code can help residents understand what options may be available when a property is not in compliance with § 16.44.040.
