Enforcement
Operative Text
(a) The building commissioner shall enforce the provisions of this article and, in addition to any other remedies provided by law may apply to the village attorney for prosecution of owners who fail to comply. (b) The building commissioner may refuse to issue any permits required under the code for any construction, alteration, installation, razing or other work done in or on any building as defined in section 6-141 of this article, or any certificate of occupancy required under the code for such a building, unless the owner(s) or other applicant for such permit(s) or certificate(s) presents either a current certificate of registration or a waiver of registration for the building. (c) The village clerk shall issue no transaction tax stamps for a transaction involving a building as defined in section 6-141 of this article unless the grantee or purchaser presents either a current certificate of registration or a waiver of registration for the building.
East Hazel Crest Ch. 6 Art. VIII § 6-147 establishes that the building commissioner is responsible for enforcing the multiple-dwelling registration requirements and may refer non-compliant owners to the village attorney for prosecution. Owners who have not obtained a current certificate of registration or a waiver cannot receive building permits or certificates of occupancy for covered properties. Additionally, the village clerk is prohibited from issuing transaction tax stamps for the sale or transfer of a covered building unless the buyer or seller presents valid registration documentation.
Plain English — not legal advice.
Under § 6-147, property owners and managers of covered multiple dwellings in East Hazel Crest should maintain a current certificate of registration—or secure an applicable waiver—before applying for any building permits, certificates of occupancy, or initiating a property transaction. Compliant operators typically keep registration documents readily accessible so they can be presented to the building commissioner or village clerk as required. Failure to maintain current registration can result in permit denials, blocked property transfers, and referral to the village attorney for prosecution.

Section § 6-147 of East Hazel Crest's Ch. 6 Art. VIII gives tenants an indirect but meaningful protection: if a landlord has not registered a covered multiple dwelling, the building commissioner can block permits and certificates of occupancy, and the village clerk can halt property sales involving that building. Tenants who believe their building may be unregistered can inquire with the East Hazel Crest building commissioner's office about the property's registration status. Tenant-rights organizations can also help residents understand how this enforcement mechanism may be relevant to their housing situation.
