Operative Text

East Hazel Crest — Ch. 6 Art. VIII Registration of Multiple Dwellings § 6-142
Buildings subject to the Illinois Condominium Property Act and cooperative buildings shall be exempt from the provisions of this article, unless a person, partnership, trust or corporation, directly or indirectly, owns or controls fifty (50) percent or more of the condominium units or fifty (50) percent or more of the voting power in the condominium association as defined by the condominium declaration, or fifty (50) percent or more of the voting power in the cooperative as defined by the agreement establishing the cooperative. Indirect ownership or control includes ownership or control by spouses (unless legally separated or divorced), children or adopted children; ownership of fifty (50) percent or more of the stock of a corporation which owns an interest in the realty and ownership of a proportionate interest in a partnership or trust which owns an interest in the realty. For purposes of this section, a cooperative building is defined as a multiple-dwelling complex owned by a cooperative corporation, stock in which affords the owner thereof the right to possess or occupy a particular family unit allocated to that stock within the complex. This right of possession or occupancy is granted through a proprietary lease or similar arrangement, and, unlike the owner of a condominium, the owner or the cooperative stock does not hold legal title to his or her individual family unit.

Plain English

East Hazel Crest Ch. 6 Art. VIII § 6-142 establishes that condominium and cooperative buildings are generally not required to register under the village's multiple-dwelling registration rules. However, this exemption disappears when a single person, partnership, trust, or corporation holds 50% or more of the units, voting power in the association, or cooperative voting power — whether directly or through family members or business entities. The provision also defines cooperative buildings for purposes of this article, distinguishing them from condominiums by the absence of individual legal title to family units.

For Property Managers

Under East Hazel Crest Ch. 6 Art. VIII § 6-142, operators of condominium or cooperative properties who remain below the 50% ownership or control threshold generally do not need to comply with the article's registration requirements. Compliant operators in this space typically track their ownership percentages carefully, including indirect interests held through spouses, children, corporations, partnerships, or trusts, to confirm whether the exemption applies to their property. When consolidated ownership crosses the 50% threshold through any combination of direct or indirect means, registration obligations under the article generally apply as they would to any other multiple dwelling.

For Tenants

East Hazel Crest Ch. 6 Art. VIII § 6-142 means that tenants living in condominium or cooperative buildings are not automatically outside the protections of the village's multiple-dwelling registration rules — if a single owner or related group controls 50% or more of the units or voting power, the building may still be subject to registration requirements. Tenants who believe their building should be registered but is not may want to review the ownership structure of their building to see whether the exemption threshold has been crossed. Tenant-rights organizations or the village's local administrative offices can be resources for understanding how this provision applies to a particular building's registration status.
