DUTIES OF VILLAGE BOARD
Operative Text
Reference To Human Relations Board: The Village Board may refer any potential or apparent instance of unfair real estate practice to the Human Relations Board for investigation, findings and recommendations. Action On Reports From Human Relations Board: Upon receipt of any report from the Human Relations Board as provided in this Chapter, and after consideration thereof at a regular meeting, the Village Board shall take such action, in its discretion, as it deems proper, including, but not limited to, initiation of an appropriate court action for injunctive relief under this Chapter, or initiation of an appropriate court action for enforcement of this Chapter. (1992 Code)
Under Clarendon Hills Ch. 27 Fair Housing § 27.8, the Village Board holds two related powers regarding unfair real estate practices. First, it may forward any suspected or apparent violation to the Human Relations Board for investigation and a formal recommendation. Second, once the Village Board receives a report back from the Human Relations Board, it must consider that report at a regular meeting and then decide what action—if any—to take, which can include seeking a court order for injunctive relief or pursuing other court-based enforcement of the Fair Housing chapter.

Property owners and managers operating in Clarendon Hills should be aware that under § 27.8, suspected fair housing violations can be escalated from the Human Relations Board all the way to the Village Board, which retains authority to initiate court action. Operators who maintain clear, consistent, and non-discriminatory policies in their leasing and management practices are generally better positioned if a referral is ever made. Keeping thorough documentation of tenant interactions, application decisions, and property policies supports a record of compliance should the Village Board ever consider action under this provision.

Clarendon Hills Ch. 27 Fair Housing § 27.8 establishes that the Village Board has the authority to act on findings from the Human Relations Board, including pursuing court-ordered relief on behalf of those affected by unfair real estate practices. Tenants who believe they have experienced discriminatory housing treatment may consider filing a complaint with the Human Relations Board, which can then report its findings to the Village Board for potential enforcement action. Consulting a tenant-rights organization or legal aid service familiar with local fair housing procedures can help individuals understand the full range of options available under this chapter.
