Location of grease containers on the public way (Chicago Health Nuisances Ordinance)
Operative Text
Grease containers may be placed on the public way in accordance with Article XIB of Chapter 10-28 of this Code and shall be granted only if the department of streets and sanitation determines that the premises has no other suitable location for the container. The commissioner of the department of streets and sanitation shall have the authority to promulgate rules and regulations regarding the definition of suitable location. (Amend Coun. J. 7-7-99, p. 6985)
Under Chicago, Ill., Mun. Code ch. 7-28 § 7-28-305, grease containers are generally not permitted on the public way unless the Department of Streets and Sanitation determines that no other suitable location exists on the premises. Placement on the public way requires approval under Article XIB of Chapter 10-28, and the Commissioner of Streets and Sanitation holds authority to define what qualifies as a 'suitable location' through rules and regulations. This provision creates a limited exception rather than a general right to use public space for grease container storage.

Property owners and managers subject to Chicago, Ill., Mun. Code ch. 7-28 § 7-28-305 generally ensure that grease containers are stored on-site whenever a suitable location is available, since placement on the public way is treated as a last resort. Compliant operators typically seek a formal determination from the Department of Streets and Sanitation before placing any grease container on the public way, and they follow the rules promulgated by the Commissioner regarding what constitutes a suitable on-site location. Keeping documentation of any departmental approval is a common practice for operators who have received permission for public-way placement.
