Plain English

Section 5.36.120 of Carpentersville's Residential Rental Licensing Program establishes a formal appeal process for anyone directly affected by a decision, notice, or order issued by the code official under Chapter 5.36. An appeal must be filed with the village manager within 21 days of the action and must be grounded in a claim that the chapter was misinterpreted or does not fully apply to the situation. Filing an appeal generally pauses enforcement of the contested action, unless the community development director determines that a delay would create an imminent risk to life or property.

For Property Managers

Under § 5.36.120, property owners or managers who receive a code official's decision, notice, or order they believe was incorrectly applied have 21 days to submit a written appeal to the village manager. Compliant operators typically document the basis for their appeal carefully, citing the specific provision they believe was misinterpreted or inapplicable, and submit the application within the required timeframe. Once an appeal is filed, enforcement proceedings are generally stayed, giving operators an opportunity to present their case at a hearing where the village manager holds broad authority to reverse, affirm, or modify the original determination.
