Buffalo Grove — Ch. 15.36 Residential Rental Housing Program § 15.36.110
If any owner, property agent, occupant or other person in control of a rental residential property or a dwelling unit contained therein fails or refuses to consent to free access and entry to the property or a dwelling unit under his control for any inspection pursuant to this Chapter, the Code Official or their designee may apply to the circuit court for a search warrant or other appropriate court order authorizing such inspections.

Plain English

Buffalo Grove Ch. 15.36 § 15.36.110 establishes that when anyone controlling a rental property or dwelling unit—whether an owner, property agent, or occupant—declines to allow inspectors free access, the Code Official is not simply turned away. Instead, the provision authorizes the Code Official or a designee to seek a search warrant or other court order from the circuit court to compel entry. This creates a legal pathway for the village to carry out inspections required under Chapter 15.36 even without voluntary consent.

For Property Managers

Under § 15.36.110, operators who participate in Buffalo Grove's Residential Rental Housing Program generally maintain a practice of granting the Code Official or their designee timely, unobstructed access when an inspection is scheduled pursuant to Chapter 15.36. Refusing or failing to provide that access does not end the matter—it triggers a court-order process that can result in compelled entry. Compliant operators typically keep records of inspection notices and coordinate access with tenants in advance to avoid delays or escalation.

For Tenants

Section 15.36.110 of Buffalo Grove's Residential Rental Housing Program affects occupants as well as owners: a tenant who controls a dwelling unit is among those whose refusal of access can prompt the Code Official to seek a court-authorized warrant. At the same time, tenants have an interest in understanding that inspections conducted under Chapter 15.36 are meant to verify housing conditions, and that the warrant process includes judicial oversight. Tenants who have questions about their rights during an inspection or about the inspection program generally can reach out to a local tenant-rights organization or the village's Code Official for information.
