Beardstown — Ch. 5 Art. VIII § 5-88 establishes a systematic inspection program, effective December 1, 2001, requiring that all rental units offered to permanent residents be periodically checked for compliance with local housing standards and other applicable laws. The rule applies broadly to rental housing but carves out several categories from its reach, including owner-occupied single-family homes, state-licensed nursing home facilities, government-inspected properties that meet equivalent standards, and short-term lodging establishments such as hotels and motels that do not house permanent residents. Properties in the exempt categories may still be subject to other applicable regulations, but they fall outside the scope of this particular inspection mandate.

For Property Managers

Under Beardstown — Ch. 5 Art. VIII § 5-88, operators of rental units that house permanent residents are subject to systematic inspections for compliance with local housing codes and related laws. Compliant operators generally maintain their properties in a condition that meets applicable standards at all times, not only in anticipation of a scheduled inspection. Landlords whose properties may qualify for an exemption — such as those already inspected by a state or federal agency under equally strict criteria — typically ensure that a copy of the relevant inspection report is filed with the city clerk as the provision requires.

For Tenants

Beardstown — Ch. 5 Art. VIII § 5-88 establishes a right for permanent residents of rental units to have their housing systematically inspected for compliance with local housing and safety standards. If a tenant believes an inspection has not been conducted or that violations exist, general enforcement paths include contacting the local city office responsible for housing inspections or raising the existence of code violations in relevant legal proceedings. Tenant-rights organizations familiar with Beardstown's rental housing rules can help residents understand how the inspection program applies to their housing situation.
