(a) The owner of a residential rental property structure, or his/her agent in charge, shall have the following responsibilities: (1) The proper installation of carbon monoxide detectors; and (2) Provide written information regarding carbon monoxide testing and maintenance to at least one (1) adult tenant in each dwelling unit. (b) Tenants of residential rental units shall periodically test carbon monoxide detectors installed therein, and replace spent, defective or missing batteries to ensure their continued safety. (c) The owner will be liable to replace detectors that malfunction due to reasons other than fault on the part of the tenant(s). Otherwise, the tenant will be charged with replacement cost. (d) No person may remove or render a carbon monoxide detector inoperative except for its periodic maintenance, or to conduct maintenance or repair to the dwelling or dwelling unit.
